1.
| SMART CENTAR rents a car mentioned of the front page, within the period of time and under the conditions set forth on both sides of this document.

| By signing this agreement the renter confirms that he had recived the vehicle in good order and condition and with a full gasoline tank if diffrent not specified on the rental agreement. |
3.
| Renter shall pay all fuell consumed during the rental. |
4.
| Renter undertakes to return the vehicle together with all tires, tools, car documents, standard and additional equipment, as it was rented. |
5.
| Renter will return the vehicle on the date specified herein or at such earlier date as SMART CENTAR may require. For each extension on the rental period, the agreement of SMART CENTAR has to be obtained 24 hours in advance and an additional sum for deposit paid simultaniously. |
6.
| The vehicle may be operated only by renter or by a such person authorized inwritting on this rental agreement, provided that such person meet all necessary qualifications and documents. |
7.
| The vehicle shall not be operated:
- for paid transportation or freight or passengers,
- to push a tow or other vehicle,
- in motor sport events or any kind of competition,
-while overloaded, i.e. carrying more passengers or freight than permitted by the car registratin papers,
- to transport animals, combustible or explosive freight with strong, unpleasent smell, or buky freight that can damage the vehicle. |

| Renter shall not assign his rights hereunder or shell the vehicle or parts thereof. |
9.
| If the renter his rental without prior agreement with SMART CENTAR the vehicle will be considered morraly and financially rensponsible. |

11.
| Renter undertakes to take good care of the car particulary, to check regulary Water, oil and the pressure and to effect the necassary changes. Receipt shall be presented to SMART CENTAR. Renter is made laible for all damages
caused by insufficient maintenance. |
12.
| Renter is liable for all damages caused to the vehicle as a result of the utilisation off the road, this also if the renter has accept the CDW, In addition, the value of the vehicle and loss of revenue due to immobilisation during the repairs. For all damages to third parties as a result of utilisation off the roads renter is liable for any expenses incurred by SMART CENTAR resultation from such damage. |
13.
| Renter is liable for all damages to vehicle caused until return of the vehicle by renter of third parties, if he had supplied. SMART CENTAR with false informations as to his identity, his address or the validity of his driver’s license. Incase of thirdparty damage renter shall be liable for any expenses incurred for replacement of same. |
14.
| Renter agrees to keep the doors of the vehicles locked and to remove the keys when not in use, and to return all car documents and car keys upon return of the vehicle. In case of noncompliance renter shall be charged expenses incurred for replacement of same. |
15.
| Renter hereby releses SMART CENTAR from and liabiltity for loss or damage to any property left, stored and transported in on upon the vehicle before of during thr rental or after the return of the vehicle. Renter agrees to hold SMART CENTAR harmless from all claims and costs bases upon such loss or damage. |
16.
| During the rental period, renter shall pay the cost or parking, trafic or other illegal violations assesed against the vehicle, as well as all other costs that are not regular. |
17.
| Renter will use his best efforts to prevents such events, shall not be liable for any faults or defects in or from mechanical failure of the vehicle. |
18.
| SMART CENTAR is not liable for any consequences caused by any defect of the vehicle during the rental. |
19.
| In case of seals damage, odometar failure, or car failure, renter shall stop driving and inform the nearest SMART CENTAR station, where he will get instructions for further procedure. |
20.
| Renter agrees to pay the amount due according to his agreement within the period of time fixed by law. |
21.
| Renter vehicle is insured with: a) comprehensive insurance and b) colision insurance. |
22.
| If the user has accept the payment in compliance with the subject Agreement the user’s liability concerning damages on the rented vehicle is completely excluded. Acceptance of CDW does not relese the user from the liability for the
cases mentioned under the item 12. 13. |
23.
| Renter should accept the terms and conditions of the Personal Accident Insurance Policy or Passengers arranged by SMART CENTAR with the Insurance Company at renter’s expence and apply for the same by signing in the space
provided therefore in the rental agreement, he shall obtain cober under the terms
as described in the respective conditions. |
24.
| Renter agrees to protect the interests of SMART CENTAR in case of accident during the rental period by
- obtaining names and address involved and the witnesses
- not abandoning the vehicle without adequate provisions for safeguarding and security the same
- calling the nearest SMART CENTAR station and giving a detailed report
- calling police in order to obtain the police report in the renter fails to take the above stated actions, he will be held responsible for any consequence caused to SMART CENTAR. |
25.
| The offical tariff in effect at the same time of rental forms and integral parts of this agreement. |
26.
| No amendments of the terms and conditions of this agreement valid unless confirmed in writting by both parties. |
27.
| Driver must have at least 23 years and 3 years of driving experience.

28.
| All disputes arising in conection with the agreement shall be settled by the authorized court in Zagreb. |
29.
| The English version of the agreement only a translation of the official croatian tex in case of disputes, only the croatian text shall be used in interpreting agreement. |
